The
Bluebird of North America has stirred people to write plays, songs and name their products after
them since the turn of the century. A growing number of persons
and businesses have sought to register the name to protect their endeavours.
The following is a chronological look at goods and services registered and the Classes for
which protection is established.
Readers
should please note that the trademark register is not a conclusive list of persons trading or with rights to
trade. This should be remembered, where traders acquire honest user
rights by long use but fail to register at the Patent Office, and the Courts usually uphold their right to trade in these
circumstances. Indeed, a mark may be granted under the 7 year honest
concurrent trader rule. Additionally, traders may come to a private
agreement involving licenses, etc., details of which licenses may not be in the
public domain.

register shows the first person to register the name "Bluebird" as
a trademark, was Unilever Plc (Unilever UK Ltd) in respect of their brand
name margarine (class 29) - in 1910. 328006

Then
in 1933 Ashbury Confectionery Ltd filed the name "Bluebird" in
classes 1, 2, 5, 29, 20 and 31. This application related to foods and
beverages. 541565
The following year 1933, they added carbonated drinks in class 32. 541566
